Lasting Power of Attorney & Deputyship

What is an LPA?

A Lasting Power of Attorney (LPA) is a legal document that lets you (the "donor") appoint one or more people (known as "attorneys") to help you make decisions or to make decisions on your behalf — if, for example, you lose mental capacity through accident or illness.

Two types of LPA

  • Health & Welfare — covering daily care, medical decisions, and where you live (including care-home residency).
  • Property and Finance — handling banking, paying bills, managing benefits and selling property.

Registration

Each LPA is registered with the Office of the Public Guardian. Registration is £82 per LPA, and processing can take up to 20 weeks. Our fees for preparing and registering an LPA are set out in our engagement letter.

Deputyship

If someone has lost mental capacity and there is no LPA already in place, the alternative is Deputyship — appointed by the Court of Protection, with annual reporting to the Office of the Public Guardian. We can guide you through the application and the ongoing reporting requirements.
